Description in English: Coastal areas are ecosystems affluent in resources that are essential to human life, and Colombia has the privilege of having a considerable extension of them. This book results from a research project on the Colombian state’s responsibility for environmental damage from maritime activities and its case-law analysis, whose starting point is Article 90 (Paragraph 1) of the Colombian Constitution. It comprises three chapters on relevant topics such as environmental and constitutional regulatory development, the various methods for regulatory interpretation, the theories of state responsibility, its definition, requirements, and case-law procedure. Finally, it presents an analysis of case-law studies that had a social, economic, and environmental impact on maritime activities (Lorsban spill in Cartagena, Cabo Tortuga in Santa Marta, Hilton Hotel in Cartagena, Santa Marta Port, among others). Thus, it intends to prove or not the theories of attribution of state responsibility, derived from the obligation to protect the environment, according to the constitution and the systematic interpretation of applicable regulations.
